Copyright Complaint Policy

The TripWays.com website (“Website”) is operated by All Seen LLC, a Delaware limited liability company (“TripWays,” “we,” “us,” or “our”). The Website hosts and may distribute content that is provided by third-party account holders, vendors, and users (collectively, “Users”), including tour and activity listings, images, descriptions, and other materials.

Given the scale of the platform, we cannot practically monitor or control all content that Users post. TripWays does not assume liability for copyright-infringing content posted by Users. The User who posts the infringing content is the responsible party. TripWays operates in accordance with the safe harbor provisions of the Digital Millennium Copyright Act (“DMCA”) (17 U.S.C. § 512). Our designated agent and registration information are below.

Our role: We act as a hosting service for content on TripWays-controlled systems (for example, pages on tripways.com) and, separately, as a distribution conduit when we syndicate or sublicense listing content to third-party partners (e.g., Google Things to do). Those roles can involve different technical steps to stop a given use of material. We do not claim ownership of content supplied by Users or suppliers.

User warranties: Users who post or supply content warrant they have the rights necessary for TripWays to host and, where applicable, distribute that content through third-party partners. Users agree to indemnify TripWays for claims, damages, and reasonable attorneys’ fees arising from a breach of that warranty, to the extent permitted by law.

Agent registration: TripWays maintains its DMCA designated agent registration with the U.S. Copyright Office and keeps the contact information below current as required to help preserve DMCA safe-harbor protections.

Copyright Infringement Notification Procedure

If you believe in good faith that material hosted or displayed by TripWays infringes your copyright, please send a written notice that includes all of the following. This is the exclusive method for notifying us of alleged copyright infringement.

Report infringement (recommended): You may submit a notice via our online form at: https://tripways.com/report-infringement

  1. Identification of the copyrighted work you claim has been infringed (e.g., description or registration number if applicable).
  2. Identification of the allegedly infringing material and information reasonably sufficient to allow us to locate it (e.g., the URL of the page or a description of where it appears on the Website).
  3. Your contact information: full name, mailing address, telephone number, and email address.
  4. Good-faith statement: “I have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.”
  5. Accuracy statement under penalty of perjury: “I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.”
  6. Physical or electronic signature of the person authorized to act on behalf of the copyright owner.

Send the notice to our DMCA Designated Agent (below). Notices that do not substantially comply with the above may not be effective.

Misrepresentations: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys’ fees. We recommend consulting a lawyer before sending a notice.

Our Response to Compliant Notices

To comply with 17 U.S.C. § 512(c)(3), upon receipt of a compliant takedown notice we will act expeditiously to remove or disable access to the material claimed to be infringing (or the subject of infringing activity).

Operational target: For valid notices that provide sufficient information to locate the material, our goal is to (a) disable access on TripWays-controlled systems and (b) suppress the same material from TripWays-managed distribution feeds (including Google Things to do, where applicable) within 24 hours. Some partner surfaces have independent caching and processing timelines.

We may provide the User who posted the material with a copy of the notice and the reporting party’s contact information. We do not reinstate removed content unless we receive a valid counter-notice that meets the DMCA requirements and we determine that reinstatement is appropriate.

Counter-Notification

If your content was removed due to a DMCA notice and you believe the removal was mistaken or that you have the right to use the material, you may send a counter-notice that complies with 17 U.S.C. § 512(g)(3) to our Designated Agent. A valid counter-notice must include, among other things, your contact information, identification of the removed material and its location before removal, a statement under penalty of perjury that the material was removed or disabled as a result of mistake or misidentification, consent to the jurisdiction of the federal court in your district (or in Delaware if outside the United States), and your physical or electronic signature. We may forward the counter-notice to the original complainant. If the complainant does not file a court action within the required period, we may reinstate the material.

Repeat Infringers

In accordance with the DMCA and our internal policies, we will terminate in appropriate circumstances the accounts of Users who are repeat infringers of copyright. We may also, in our sole discretion, limit access, suspend, or terminate Users who infringe the intellectual property rights of others, whether or not there is a pattern of repeat infringement. For vendors or suppliers whose content is distributed to partners, we may also withhold that content from distribution feeds (for example, Google Things to do) after multiple valid infringement notices, in addition to other account remedies. Users who upload content represent that they have the necessary rights to post and to allow TripWays to use and distribute that content as described in our Terms of Use and related policies; Users who breach that representation may be held responsible and may be removed from the platform.

Third-Party Distribution

Content may be syndicated or distributed to third-party partners (e.g., search engines or map services). Upon receipt of a compliant DMCA notice, we will act expeditiously to remove or disable access to material on TripWays-controlled systems as required by law. Additionally, where practicable and consistent with our partner agreements and technical capabilities, we will notify applicable distribution partners and request that they remove or disable access to the same material (or equivalent listings) in their systems. We cannot guarantee timing or completeness of partner action; partners maintain their own processes. If you see the same content on another site or surface, you may also need to contact that operator’s designated agent.
