Service Agreement

Thank you for choosing TripWays. This Service Agreement (this “Agreement”) is between you (“Customer,” “you”) and All Seen LLC, a Delaware limited liability company doing business as TripWays (“TripWays,” “we,” “us,” or “our”).

This Agreement governs your use of the travel booking and tour services provided through TripWays.com (the “Website”). It is part of the overall agreement between you and TripWays that also includes our Terms of Use, Privacy & Cookie Policy, Copyright / DMCA, Marketplace Services Addendum (for marketplace bookings), and any tour-specific or supplier-specific terms disclosed on the listing or at checkout for your booking. In the event of a conflict between this Agreement and the Terms of Use or Privacy Policy, this Agreement will prevail with respect to booking, payment, cancellation, and travel services.

What controls for your trip: For each experience, the price, payment schedule (for example deposit vs. full payment and due dates), what is included or excluded, and cancellation and change rules are those shown on the tour page (including supplier-provided descriptions and cancellation policy content) and presented again in the booking and checkout flow (for example, Bokun-powered calendar, checkout, and confirmation). Those terms are set by or on behalf of the supplier for that product. This Agreement does not replace or override the fees, deadlines, or refund rules displayed for your specific booking unless we say otherwise in writing for that booking.

By completing a booking on the Website (including any payment required at checkout), you agree to this Agreement and to the supplier/checkout terms applicable to that booking.

Loyalty cashback (Elite partners). TripWays may offer a separate loyalty cashback on qualifying bookings with certain Elite integration partners. That cashback is not part of the tour fare at checkout and does not reduce the price shown in the live booking flow. Program rules, eligibility, and payouts are described in our Elite Loyalty Program Terms.

BOOKING

Marketplace bookings and checkout

TripWays operates a dynamic marketplace. Most experiences are offered and fulfilled by independent suppliers (vendors). TripWays facilitates discovery, booking, payment (through integrated checkout where available), and customer support. Your contract for the travel service is with the identified supplier for that listing, subject to the terms shown on the listing and at checkout, and our Marketplace Services Addendum where it applies.

TripWays does not state a single fixed commission percentage that applies to every booking in this Agreement. The total price you see for your dates and party at checkout is what you agree to pay for that transaction (subject to correction of clear errors as allowed below).

Pricing, currency, and availability

  • Listings typically quote in U.S. Dollars unless another currency is shown on the page or checkout.
  • Prices and availability can change until your booking is confirmed by the supplier or system. Suppliers or platforms may correct pricing errors before or after checkout in line with their policies and applicable law.
  • Taxes, fees, and surcharges (for example service fees, facility fees, or taxes collected at checkout) are those itemized or referenced in the checkout flow for your booking.

Payment

  • You authorize TripWays and/or payment processors used in checkout to charge your payment method as shown at checkout (for example full payment, deposit, or installment, if offered for that product).
  • Available payment methods depend on the checkout configuration for that booking (for example card, PayPal, or other rails shown in the flow).
  • If a scheduled payment fails, the supplier’s rules shown at booking (for example forfeiture, cancellation, or retry) may apply. Keep payment details current.

Inclusions and exclusions

What is included or not included in the fare is described on the specific tour or activity listing and in checkout. Unless the listing states otherwise, examples of items often not included are: visas and entry documents; airfare to or from the experience unless expressly included; personal expenses; travel insurance; payment-method fees; and gratuities.

Group size, format, and minimum participants

Whether an experience is shared with other guests, private, requires a minimum number of participants, or has other format rules is stated on the listing. If a minimum is not met or the supplier cancels for operational reasons, refunds or alternatives follow the supplier policy and listing terms shown before purchase.

Passports and visas

You are responsible for valid travel documents. Many destinations require a passport valid at least six (6) months beyond travel and sufficient blank pages. Visa, entry, and transit rules depend on your nationality and itinerary—confirm with the relevant embassy, consulate, or official source.

Names on bookings

Traveler names should match travel documents. Incorrect names may prevent travel or be treated as a change or cancellation under supplier rules. If you book for others, their names must match their documents.

Changes to bookings

Changes (dates, party size, options) depend on supplier rules, availability, and any fees shown in the booking path or confirmation. Request changes through support or the channel provided in your confirmation (for example supplier or platform self-service). TripWays will help where we reasonably can, but we cannot guarantee changes beyond what the supplier allows.

CANCELLATION AND REFUND

Policy that applies to your booking

The supplier’s cancellation and refund policy for the product you purchased—including deadlines, fees, non-refundable amounts, and any “free cancellation” window—is the one displayed on the tour page (including cancellation policy fields and narrative supplied for that product) and made available in the booking/checkout process and confirmation. That policy controls how much you may owe or recover if you cancel or if the supplier cancels, except where mandatory consumer law says otherwise.

If anything in this Agreement conflicts with the cancellation/refund terms shown for your specific booking, those booking-specific terms control for amounts, timing, and refunds.

How to request cancellation or a refund

Use the cancellation or change path in your booking confirmation or supplier platform when available. You may also contact [email protected] with your booking reference; we will route your request to the supplier or processor as appropriate. Refund processing times depend on suppliers, banks, and payment processors; we will use reasonable efforts to help you obtain a timely outcome consistent with the applicable policy.

Promotional and special offers

If a listing or checkout states that a rate is non-refundable, final sale, or subject to stricter rules, those terms apply to that purchase.

Time zones and deadlines

Cutoff times in supplier cancellation policies usually refer to the timezone stated with the policy or the local time of the experience—follow the wording shown with your booking.

GENERAL TERMS

8. Travel Insurance

We do not provide travel insurance. We encourage you to purchase coverage from a provider you choose. We do not assume liability for uninsured losses. All claims are between you and your insurer.

9. Hotel Policies

Hotels may require a credit card or cash deposit at check-in for incidentals (e.g., minibar, damage). Their policies apply.

10. Complaints

If you have a complaint during your trip, please raise it promptly with the supplier or guide so it can be addressed on the ground. You may also contact TripWays by email, phone, or chat. We cannot resolve issues we are not informed of in a timely way.

11. Baggage

You are solely responsible for your baggage. We are not liable for loss, theft, or damage. Follow sensible limits for your mode of travel.

12. Shopping and Local Purchases

You are not obligated to purchase anything. You are solely responsible for your purchases and for complying with customs and import rules of your home country. You may not purchase live animals or prohibited or hazardous items during the experience.

13. Health and Accessibility

  • Travelers should be in good health appropriate for the activity. You may need to board/disembark transport, walk, and carry luggage. Disclose any condition that might affect you or others or require special accommodation when you book.
  • We will use your health information in accordance with our Privacy Policy. We make reasonable efforts to accommodate disabilities but suppliers (hotels, operators, etc.) ultimately deliver the service. We cannot assist with personal care or medical tasks. A qualified companion may accompany you at their own cost. We may decline participation if fitness or conduct would endanger others or materially disrupt the experience. We cannot guarantee accommodation of all dietary restrictions or allergies.

14. Conduct

  • No refund is given for unused portions of an experience unless the supplier policy says otherwise.
  • You must respect guides, suppliers, fellow guests, and local laws. Suppliers or TripWays may remove you from an experience if behavior is inappropriate, disruptive, offensive, or dangerous. In that case, refunds follow supplier policy; you may need to arrange your own onward travel.

15. Liability

  • We are not responsible for: acts or omissions of suppliers, contractors, transport operators, hotels, or other third parties; natural disasters, severe weather, or other force majeure; terrorism, unrest, or war; other travelers or third parties; your accidents, medical emergencies, or personal emergencies; services you arrange outside the booked experience; shopping or add-ons; price changes due to tariffs, fuel, taxes, currency, or events; or defaults or negligence of third parties.
  • You agree that TripWays does not own or employ third-party suppliers. Disputes with suppliers should be raised with them as well as with us where we can assist.
  • Our liability for changes or cancellations attributable to TripWays in its marketplace role is limited to refund of amounts paid to us for the affected booking to the extent not already governed by the supplier refund policy, except where law requires otherwise.

16. Governing Law; Arbitration; Venue

  • This Agreement is governed by the laws of the State of Delaware, without regard to conflict of laws principles.
  • Any dispute arising out of or relating to this Agreement or your booking may be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, in New Castle County, Delaware, in English. Either party may seek injunctive or other equitable relief in court to protect intellectual property or to prevent misuse of the Website.
  • To the extent a claim may be brought in court, you consent to the exclusive jurisdiction of the state and federal courts in Delaware.

17. Attorney Fees

In any action or arbitration to enforce or interpret this Agreement, the prevailing party is entitled to recover reasonable attorneys’ fees and costs.

18. Severability

If any part of this Agreement is held invalid, the rest remains in effect.

19. Binding Effect

This Agreement binds you and your heirs, executors, administrators, and successors.

20. Entire Agreement

This Agreement, together with the Terms of Use, Privacy & Cookie Policy, Marketplace Services Addendum (where applicable), Copyright / DMCA policy, Elite Loyalty Program Terms (where applicable), and the listing and checkout terms for your booking, is the entire agreement between you and TripWays regarding booking and marketplace travel services and supersedes prior general understandings on that subject.

21. No Third-Party Beneficiaries; Assignment

No one else has any rights under this Agreement as a third-party beneficiary. You may not transfer a confirmed booking to another person except as allowed by the supplier or checkout rules; you may book for others if names and documents match.

22. Consent

Completing a booking on the Website (including payment as required at checkout) constitutes your acceptance of this Agreement and of the supplier/checkout terms that apply to that booking.
