Marketplace Services Addendum

This Marketplace Services Addendum (“Addendum”) is part of the agreement between you (“Customer, Vendor, Affiliate”) and All Seen LLC, a Delaware limited liability company doing business as TripWays (“TripWays,” “we,” “us,” or “our”). It governs your use of third-party marketplace travel services offered through TripWays.com.

By booking or using marketplace services, you agree to this Addendum in addition to our Terms of Use, Terms & Conditions, and Privacy Policy

Bokun Marketplace Integration

TripWays partners with Bokun, a third-party marketplace and booking engine, to give you access to a large network of travel destinations and service providers globally. Services booked through our marketplace are provided by those third-party suppliers and are subject to this Addendum and our general Terms & Conditions.

Agency Relationship

TripWays acts only as an intermediary between you and third-party service providers. We do not own, operate, or control those providers or their services. We are not a travel agency, tour operator, or direct service provider in respect of marketplace listings; we operate a platform that facilitates discovery, booking, and payment. Your contract for the actual experience (e.g., tour, activity, accommodation) is with the identified supplier, with TripWays facilitating the transaction.

Service Provider Contracts

When you book through our platform, you enter into a service agreement with the identified third-party provider. TripWays’ role is to facilitate the booking, process payment as agreed, and support communication. Any digital or other contracts between TripWays and suppliers (e.g., on the Bokun platform) govern our relationship with those suppliers and do not change your rights and obligations under this Addendum or our Terms & Conditions.

Supplier Content and Distribution

• Listing content (descriptions, images, prices, policies) is supplied by third-party suppliers, not by TripWays. We do not guarantee the accuracy, completeness, or legality of that content.
• TripWays may display, syndicate, or sublicense supplier-provided content to distribution partners (including search engines and map services, e.g., Google Things to do) so that offerings can be discovered and booked. Those partners may have their own terms and retention practices.
• Once content has been shared with distribution partners, it may be incorporated into fixed media (e.g., cached pages, screenshots, promotional materials, or archives). TripWays may not be able to remove or recall that content from third-party systems after it has been distributed, even if a listing is later changed or removed on our site.

Pricing and Currency

• Prices are shown in U.S. Dollars unless otherwise stated. Prices may change due to currency movement, supplier updates, or other factors. TripWays may correct pricing errors at any time before confirmation.
• You are responsible for the total amount confirmed at checkout, including any taxes or fees we disclose.

International Services

Services may be provided outside the United States. Different safety, quality, and legal standards may apply. TripWays does not represent that international supplier services will meet U.S. or any other specific standards.

Data Protection and Cross-Border Transfer

• Data needed to fulfill your booking (e.g., name, contact, travel dates, special requests) will be shared with Bokun and the relevant supplier(s). That may involve transfers to countries other than your own.
• We handle data in line with our Privacy Policy and applicable data protection laws.

Complaint Resolution

For issues with a marketplace booking:

1. First, contact TripWays (e.g., [email protected] or our support channels).
2. If we cannot resolve it, we may escalate to the relevant supplier. You agree to cooperate with that process.
3. Final resolution may be subject to the supplier’s own policies and procedures. TripWays is not responsible for supplier conduct or decisions beyond our obligations under this Addendum and our Terms & Conditions.

Governing Law

This Addendum is governed by the laws of the State of Delaware, United States of America, without regard to conflict of laws principles.

Amendments

We may update this Addendum from time to time. The current version will be posted on this page with an updated date. Your continued use of marketplace services after changes take effect means you accept the updated Addendum.
